IS IT LEGAL TO GROW CBD IN SPAIN?

To understand whether it's legal to grow CBD in Spain, it's first necessary to understand what CBD is. CBD, or cannabidiol, is a chemical compound found in the cannabis plant that has gained popularity for its therapeutic properties, as it has been shown to reduce anxiety, relieve pain, and reduce the symptoms of some diseases.

In Spain, the 1967 drug law prohibits the cultivation, production, and sale of cannabis and its derivatives. However, in In 2013, a law was passed allowing the cultivation of cannabis for research and medicinal purposes.This means that it is legal to grow cannabis to produce CBD as long as it is done for scientific and medical purposes. Under current legislation, the cultivation and production of cannabis flowers for CBD production is completely legal, as long as the legal maximum of 0.2% of THC (tetrahydrocannabinol, the active ingredient in marijuana), which is actually the prohibited psychoactive ingredient, is not exceeded. And this is one of the areas where problems have increased for farmers who have decided to jump on the bandwagon of this industry.

In some areas of Spain, CBD cultivation is accepted and supported by the authoritiesFor example, the Madrid City Council has approved CBD production, meaning farmers in Madrid can cultivate CBD without fear of retaliation. This is because the Madrid City Council believes CBD can provide significant health benefits to citizens.

Furthermore, in 2018, the Spanish Ministry of Health published a ministerial order which allows the sale of CBD-based products with a THC content of less than 0.2%. THC is the psychoactive compound in cannabis that produces psychotropic effects, so the sale of products with a content above 0.2% is prohibited.

When it comes to growing cannabis for CBD production, there are certain restrictions. First, a special license is required to grow cannabis for research and medicinal purposes, so anyone wishing to grow cannabis for CBD production must first obtain this license.

CBD is controlled and included in Schedule III of the United Nations Convention on Drugs (UNCDC) 61, but the UNCDC 71 states that CBD should not be controlled or prosecuted as a drug.
