Today, we find ourselves in a context in which global measures related to marijuana are beginning to change, or rather, are constantly changing, especially when we refer to the use of cannabis for medicinal purposes.
Medical cannabis
When we talk about medical cannabis, we usually mean one of the main components of these plants, CBD, or cannabidiol. CBD is the component of the cannabis family that, unlike its sister plant, THC, does not produce any psychoactive effects in users; that is, it does not produce the sensation of being stoned or "high." CBD is primarily known for its anti-inflammatory and analgesic properties, although its benefits extend far beyond that.
Marijuana plants at home
But enough about the technicalities of these components for now. If you're reading this article, you're probably looking to grow your own marijuana plants at home, but aren't entirely sure if this is legal. The answer to whether it's legal to grow marijuana plants in Spain is yes, but only partially.
It is legal to grow cannabis in Spain as long as the plants are CBD plants and, in accordance with the regulations of the Spanish Agency for Medicines and Health Products (AEMPS), their THC content does not exceed 0.2%, both for cultivation and for sale.
At the same time, the seeds to be planted must belong to the industrial hemp variety, also known as Sativa L, and must be certified. Therefore, it's recommended that when searching for and choosing a brand or seed bank from which to purchase your CBD plant seeds, you look for well-known brands already established in this market to avoid potential setbacks.
Municipal registry
It is also important to highlight that, once the plant's products, as well as their derivatives, whether oil or other forms of consumption, have been cultivated, they must undergo a control process carried out by the corresponding municipal registries.
However, the thought of having to deal with legal procedures to grow a plant at home may sound somewhat discouraging. Don't worry, that's not the case. There's no longer any obligation to notify the authorities when starting a legal CBD grow.
However, as a legal CBD grower, it's recommended that you keep the labels or packages of the seeds you're growing for at least 12 months from the date of purchase to avoid problems. This will allow you to demonstrate that the plants you're growing do not exceed the legal limits, specifically that they do not contain more than 0.2% THC.
Now that you know that growing CBD in Spain is legal, all that's left is to choose your seeds, germinate them, and start producing your own medicinal cannabis.
